Whispered – Terms of Service

Welcome to Whispered ("the App"), an AI-powered relationship simulation role-playing game. These Terms of Service ("Terms") govern your use of Whispered, operated by Artifectus, MB (company code: 307536402), a company registered in Lithuania ("we," "us," or "our"). By using Whispered, you agree to these Terms. If you do not agree, please discontinue use.

1. Eligibility

• You must be at least 18 years of age to use Whispered.
• By using the App, you confirm that you are 18 or older and legally capable of entering into this agreement.
• The App is not intended for minors and may contain themes suitable only for adults.

2. Entertainment Purpose Only

• Whispered is a fictional AI roleplaying game built solely for entertainment purposes.
• All characters, dialogue, and content are generated by artificial intelligence and are entirely fictional.
• Nothing produced by the App should be considered real, factual, or advice of any kind — including emotional, psychological, medical, or legal advice.
• Any resemblance to real persons, living or dead, is purely coincidental.

3. Mature and Sensitive Content

• The App may include fictional storylines that involve mature themes such as romance, emotional relationships, or conflict.
• Such content is generated automatically by AI based on user input and is not manually reviewed or pre-written.
• While the App does not generate explicit adult imagery or pornography, some fictional interactions may include suggestive or mature dialogue.
• No user-to-user interaction: Users only chat with AI characters, never with other users.
• All content is purely fictional AI-generated entertainment with no connection to real people or relationships.
• If you find such material offensive or inappropriate, please discontinue use.

4. User Conduct

You agree that you will not:

1. Use the App for any illegal, harmful, or abusive activity.
2. Upload or share illegal, pornographic, or explicit real-world material.
3. Use the App to harass, exploit, or harm others.
4. Generate or encourage content that promotes hate, violence, or discrimination.
5. Attempt to "jailbreak" or manipulate the AI into bypassing safety guidelines or generating inappropriate content.
6. Reverse-engineer, copy, or interfere with the App's operation.

Violation of these rules may result in account suspension or termination.

We reserve the right to report illegal activity to authorities.

5. AI-Generated Content Disclaimer

• All in-app interactions are created by artificial intelligence responding to your input.
• The developer does not pre-review, control, or endorse this content.
• You understand that the AI may produce inaccurate, offensive, or unpredictable text.
• By using the App, you accept this risk and agree that all content is fictional.

6. Intellectual Property and Generated Content

• All content generated by the App, including but not limited to text, images, character profiles, and dialogue, is owned by us.
• AI-generated images sent to you during conversations remain our exclusive property and may be reused across multiple user interactions.
• You are granted a limited, non-exclusive license to view and interact with generated content solely within the App for your personal entertainment.
• You may not reproduce, distribute, modify, or commercially exploit any AI-generated content outside of the App without our explicit written permission.
• Your input and prompts to the AI do not grant you ownership rights over the resulting generated content.

7. Account Creation and Access

• Sign-in occurs via magic link sent to your email.
• You are responsible for securing access to your email and preventing unauthorized use.
• You are responsible for maintaining access to your registered email address. If you lose email access, you will be unable to sign in to your account. For account recovery assistance, contact [email protected], though recovery may not always be possible.
• Do not share access with others or impersonate another person.

8. Account Termination and Deletion

• You may request account deletion at any time by contacting [email protected] or using in-app settings (if available).
• We may suspend or delete accounts that violate these Terms or are used for unlawful purposes.

9. Cancellation and Refund Policy

• Subscription Cancellation: You may cancel your paid subscription at any time through your user profile section in the App.
• Cancellation Effect: Cancellations take effect at the end of your current billing period. You will retain access to premium features until your paid period expires.
• No Refunds: All payments are final and non-refundable. We do not provide refunds for partial billing periods, unused time, or any other circumstances.
• Billing After Cancellation: Once cancelled, your subscription will not automatically renew, and no further charges will be made to your payment method.

10. Data and Privacy

We collect only what is needed to operate the App — primarily your email, username, and IP address logs for security. Conversation data is stored indefinitely to maintain your chat history and character relationships unless you delete your account. For full details, see our Privacy Policy.

11. Limitation of Liability

• To the fullest extent permitted by law, Whispered and its developer provide the App "as is" without warranties of any kind.
• We are not responsible for errors, downtime, or objectionable AI-generated content.
• You use the App entirely at your own risk.

In no event shall our total liability to you exceed the amount (if any) you have paid to use the App during the twelve (12) months prior to the event giving rise to the claim. If you use the App free of charge, our total liability shall be zero.

You further agree to indemnify and hold harmless the developer from any claims or losses resulting from your use of the App.

12. Changes to the App or Terms

We may modify or update the App or these Terms at any time. The latest version will always be available in the App or on our website. Continued use after updates means you accept the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict of law principles.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App, the parties shall first attempt to resolve the matter amicably through informal communication.

If an amicable resolution cannot be reached within a reasonable time, the dispute shall be submitted to the competent courts of Lithuania, which shall have exclusive jurisdiction.
